General conditions of sale for the Events and Leisure agency

ARTICLE 1: INSURANCE – LIABILITY

The organizer is civilly liable for the proposed activities in the event of damage resulting from a fault or error in the organization. He has taken out a traffic liability insurance policy with the insurance company Allianz for each Segway and scooter and a professional liability insurance policy also with Allianz (certificate upon request). The participant confirms that he is fully aware of the risks inherent in practicing the proposed activities. The organizer cannot be held responsible in the event of an accident, each participant must answer for all damage to himself resulting from his own fault or negligence. In this case, it is up to him to use his personal insurance.


ARTICLE 2: PRICES

All our prices are inclusive of VAT for individuals, and exclusive of VAT for businesses and local authorities. We are subject to VAT at a rate of 20%. The pricing method is always specified in our price offers.


ARTICLE 3: CANCELLATION CONDITIONS FOR PRIVATE CUSTOMERS

Cancellation is only possible in case of very bad weather, for safety or practicability issues where any risk is decided by the Events et Loisirs team only. In case of cancellation by the client from D-5 the total amount of the service is due. In case of cancellation by Events et Loisirs the service may be postponed or refunded (within 96 hours) depending on the request. Unless otherwise agreed by us, the number of participants booked will be the number of participants invoiced. Cancellations must be made by email to: contact@events-et-loisirs.com. Any delay of the participant(s) of more than 15 minutes will result in the cancellation of the outing without refund or postponement.


ARTICLE 4: CONDITIONS OF USE OF GIFT CARDS

Tours must be booked in advance and at least 21 days in advance. In the case where the gift is a voucher or gift certificate for 1 person, the participant must allow as much notice as possible because our tours depart with a minimum of 2 people (the shorter the notice, the less choice will be given our many services). Gift boxes, gift certificates, and gift certificates are non-refundable and cannot be the subject of any financial compensation. In the event of a no-show on the day, the reserved gift box will be permanently lost and cannot be replaced or postponed to a later date. This gift certificate is valid for a period of one year from the date of purchase. A fee of €10 will be charged per gift card in the event of an extension (maximum 3 months). You have the possibility to change category for the price difference.


ARTICLE 5: GROUP CANCELLATION CONDITIONS

From D-30 days to D-20 of the service, the 50% deposit will be retained, less than 20 days before the service, the penalty is 100% and the entire service must be paid. The number of participants invoiced will be the number of participants on the order form. In case of cancellation after signing the order form and payment of the deposit by the customer, an administration fee of €100 for any order less than €2,000 and €500 for any order greater than €2,001 for cancellation fees and work carried out. The number of participants must be defined 10 days before the date of

service and will be the number billed.


ARTICLE 6: WEATHER CONDITIONS

In the event of a special weather forecast, i.e. storm, hail, hurricane, etc. Only the instructors present will be authorized to cancel or maintain the initially planned program. For safety reasons, the route may be modified by the instructor without notice, the time of the ride will be respected and will not give rise to reimbursement.


ARTICLE 7: SPECIAL CONDITIONS FOR THE PRACTICE OF THE SEGWAY® GYROPOD

Each participant in our activities receives specific training prior to using the Segway® gyropode. This training is carried out by a certified Segway France instructor. For technical reasons related to the operation of the Segway® gyropode, people weighing less than 40kg and more than 118kg cannot participate in our activities. For safety reasons, people with inner ear problems and pregnant women cannot ride a Segway® gyropode. The minimum age required to use a Segway gyropode is 12 years old. If the required weight is reached (EDPM legislation of October 21, 2019), it must be accompanied by a responsible adult up to the age of 16. Any false declaration regarding the age of minors is the sole responsibility of the parents. The instructor reserves the right to cancel the service in the event of fraud regarding the participant's age, without refund. All our tours are accompanied by a certified instructor. Segway gyropode is authorized on sidewalks and pedestrian areas in built-up areas. Wearing a helmet is mandatory. Driving the gyropode is prohibited under the influence of alcohol and the instructor reserves the right to refuse the person in a state of intoxication or other manifest without refund.


ARTICLE 8: DANGEROUS BEHAVIOUR

The instructors present in supervision of our activities are responsible for the safety of the group, as such, they can decide to exclude a participant whose behavior is deemed dangerous, who shows incivility and who does not respect the traffic and safety rules relating to the use of the Segway® gyropode.


ARTICLE 9: REGULATIONS.

Any order from groups, companies, or communities must be the subject of a duly signed quote returned with the words "good for agreement" defining the services and the conditions of performance and constitutes acceptance of our General Terms and Conditions. The order is firm and final upon receipt of the signed, stamped quote and payment of a 50% deposit. Unless otherwise stipulated, the balance must be paid within 8 days of the service.


ARTICLE 10: DISPUTE

Any dispute that may arise from this contract will be subject to the jurisdiction of the commercial court of Grenoble.


ARTICLE 11: ACCEPTANCE

The buyer declares to have read the general conditions of sale and accepts them without reservation.


ARTICLE 12: COMPLAINT

Any complaint against Events et Loisirs agencies must be sent by registered mail to Events et Loisirs, 83 impasse Lavoisier, 38530 Pontcharra, within a maximum of 7 working days of the end of the service. After this period, no complaints will be admissible.
